The Importance Of Legal Paternity Testing

By Ronald Jackson

Currently, DNA testing is all the rage when it comes to seeking information about ancestry and heritage. While this is the case, there are a number of other reasons individuals seek out such tests. In one case, DNA is used in legal paternity testing to confirm the biological connection between father and child.

When DNA is used for legal issues related to determining whether or not there is a biological connection between two individuals, genetic fingerprinting is used to prove whether each individual shares the same biological markers. In most cases, this type of testing is used to determine whether an individual is the birth father of a child. Whereas, there are new maternity tests which can now show whether a woman is the birth mother of an individual.

While focused mostly on parents, there are now DNA tests which also provide information with relation to the biological connection between grandchildren and grandparents. While newer DNA tests are often considered the most accurate, older methods are still in use which include blood group typing, analysis of enzymes and proteins and though the use of leukocyte antigen antigens.

Polymorphism or RLFP and polymerase or PCR are two types of tests which are related to DNA matching. In addition, paternity tests can now be completed at any point during pregnancy. In the case of DNA matching in an unborn child, DNA is acquired from the individual believed to be the father and matched to that of the unborn child.

When being used for legal reasons, there are specific factors which must be included during DNA tests. One of the most important factors is that those seeking such tests choose a reputable firm which has authority to provide legal DNA tests. For, there is a percentage related to the DNA match involved in the process which follows the chain of custody often used in the process.

In most cases, those seeking DNA tests for legal reasons are doing so for purposes such as adoption, immigration, social welfare benefits, inheritance or child support. As such, the testing needs to be provided a reputable source whom can provide accurate testing. To satisfy the chain of custody requirements, all parties being tested have to present positive identification such as a birth certificate and picture ID along with specimens collected by a third party professional with no relation to those being tested or interest in the results of the test.

Lastly, the evidence must be so strong that a judge or other official can be as close to 100% sure as possible that the test results are accurate. In most cases, it is advised that the evidence submitted is stronger than that of DNA found in a number of civil or criminal cases. For, the results must show beyond a reasonable doubt that the two individuals share the same DNA before any legal action such as obtaining child support or filing for adoption of a child can be finalized.

Those working in this area related to immigration in countries such as the United States, United Kingdom, Canada, Australia and France have been requesting DNA tests to determine biological connections in situations in which birth certificates or other documents are not available. While this is the case, very few countries have actually began requiring individuals undergo such tests. For, it can often hard to assure that a test is accurate when the petitioners and beneficiaries can not provide valid forms of ID.
